PRIVACY NOTICE

PLEASE READ THIS NOTICE CAREFULLY TO UNDERSTAND HOW WE TREAT YOUR PERSONAL INFORMATION AND WHAT CHOICES AND RIGHTS YOU HAVE IN THIS REGARD. IF YOU DO NOT AGREE WITH THE TERMS AND CONDITIONS OF THIS NOTICE, YOU SHOULD NOT ACCESS OR USE THE APP.

THIS APP IS INTENDED FOR USERS LOCATED IN THE UNITED STATES, AND IT IS NOT INTENDED FOR USERS LOCATED IN OTHER COUNTRIES, INCLUDING THE EUROPEAN UNION AND THE EUROPEAN ECONOMIC AREA.

IF THE PLAYER IS UNDER THE AGE OF 13, PLEASE SEE THE “CHILDREN’S ONLINE PRIVACY” SECTION OF THIS NOTICE FOR IMPORTANT INFORMATION.

INTRODUCTION

The Trainer mobile application is operated by Praxis Tech, Inc. (referred to herein as “we,” “us,” and “our”). We are committed to protecting the privacy and security of the personal information we collect, use, share, and otherwise process as part of our business. We also believe in transparency, and we are committed to informing you about how we treat personal information. This Privacy Notice (the “Notice”) applies to the personal information we collect and process via the Trainer mobile application (the “App”), and it explains the rights you have regarding this information.

WHAT INFORMATION DO WE COLLECT?

We collect the following information for the purposes described in the “How Do We Use and Share Your Information?” section of this Notice.

Account Information

When you register for an account, we ask for your name, email address, and a password that you create.  You must be at least 18 years old to create an account.

Player Profile Information

During registration, you will also provide the player’s name.  If the player’s team is using the App, the player’s club, age-group, and team will be pre-populated based on the registration code and information from the team.

Once you have registered and subscribed to our services, you will create a profile for the player. You may choose to provide the player’s photo as well as videos and content that you submit to be reviewed by the coach. We will track which challenges the player has completed.

Only a parent or legal guardian may provide Player Profile Information for children under the age of 13.

In-App Purchases

Users are required to purchase a subscription from us to use our services. This occurs via in-app purchase. We do not receive or store payment information, but we will receive information about which subscription is purchased, the date of purchase, and the subscription expiration date. You must be at least 18 years old to purchase a subscription.

Coach Information

If registering to use the App as a coach, we will collect your club’s name, information about your experience, and a profile photo.

Device Permissions

Users may grant the following device permissions in the App:

  • Camera and Photos. This permission allows the App to access the device’s camera as well as images and video stored on the device. If this permission is granted, the App can create and save photos and videos on the device and access photos and videos already stored on the device.
  • Push Notifications. This permission allows the App to send push notifications on the device. If granted, we may send a push notification to alert you of a notification in the App.

Device permission requests are limited to those that are necessary to implement the App.  You may change your preferences regarding device permissions at any time by changing the settings on your device. Opting-out will cause the associated features to be disabled in the App.

Device Information

When you use the App, we automatically collect information from your device, which includes the date and time of access, your location, your Internet Protocol (IP) address or unique device identifier, your operating system, and your device type.

Your Communications and Feedback

If you provide us with feedback or contact us for support or to ask us questions, we will collect your name, email address, message, and other information needed to respond to your feedback, or request for support, or to answer your question. When you communicate with us, we may retain your communications in order to process and respond to them, as well as to improve our services. We may use your email address to communicate with you or send you periodic emails.

HOW DO WE USE AND SHARE YOUR INFORMATION?

How do we use the information described in this Notice? We use the information listed above in order to:

  • Operate and improve our business and the App;
  • Provide you with the services, content, and functionality you request;
  • Honor our terms of use and contracts;
  • Manage our relationship with you;
  • Process payments or other transactions, including in-app purchases;
  • Improve our products and services and develop new products and services;
  • Develop algorithms and artificial intelligence solutions for reviewing player submissions;
  • Maintain our databases and back-ups, including records of our communications with you;
  • Ensure the privacy and security of our App and services;
  • Detect fraud and prevent loss;
  • Improve our customer service;
  • Communicate with you and respond to your feedback, requests, questions, or inquiries;
  • Improve our marketing efforts, including by providing more tailored advertising;
  • Administer a contest, promotion, or survey;
  • Assess the success of our marketing and advertising campaigns;
  • Support and improve the App, including evaluations of functionality and features;
  • Analyze use of the App and our services and prepare aggregate traffic information;
  • Recognize your device and remember your preferences and interactions;
  • Provide you with a more personal and interactive experience on the App;
  • Determine and track user interests, trends, needs, and preferences;
  • Facilitate corporate mergers, acquisitions, reorganizations, dissolutions, or other transfers;
  • Obtain and maintain insurance coverage, manage risks, and obtain professional advice;
  • Accomplish any other purpose related to and/or ancillary to any of the purposes and uses described in this Notice for which your information was provided to us;
  • Accomplish another purpose described to you when you provide the information, for which you have consented, or for which we have a legal basis under law;
  • Comply with federal, state, or local laws;
  • Comply with a civil, criminal, or regulatory inquiry, investigation, subpoena, order, or summons by federal, state, or local authorities;
  • Cooperate with law enforcement agencies;
  • Exercise or defend legal rights or claims; and
  • Collect, create, use, retain, or disclose deidentified or aggregated data.

Within the App

We will only share each player’s information and submissions via the App with his/her coach.  Coaches will be able to review videos and content, rate players’ progress, and provide feedback.

Corporate Affiliates

We may share information with our corporate subsidiaries and affiliates and with their respective officers, directors, employees, accountants, attorneys and agents.

Acquisitions and Similar Transactions

We may disclose information in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our company assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding.

Legal Obligations and Rights (Subpoenas, Court Orders, and Warrants)

We may disclose information in response to subpoenas, warrants, court orders or other legal process, or to comply with relevant laws. We may also share information in order to establish or exercise our legal rights; to defend against a legal claim; and to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our contracts.

Disclosures with Your Consent

We may ask if you would like us to share information with other unaffiliated third parties who are not described elsewhere in this Notice. We will only disclose personal information in this context with your consent.

Service Providers

We may share information with our service providers that need access to the information to provide operational or other support services on our behalf. Among other things, service providers help us administer the App, support our provision of services, provide technical support, send communications, and assist with other legitimate purposes permitted by law.

Professional Advisors

We may share information with our insurers and other professional advisors, including attorneys and accountants, that need access to the information to provide operational or other support services on our behalf.

Deidentified or

Aggregated Data

We may disclose aggregated information or de-identified information about our users that does not identify any specific individual, such as groupings of demographic data or customer preferences.

HOW LONG DO WE STORE AND USE YOUR PERSONAL INFORMATION?

We retain and use personal information for as long as is necessary to fulfill the purposes for which it was collected, to comply with our business requirements and legal obligations, to resolve disputes, to protect our assets, to provide our services, and to enforce our agreements.

We take reasonable steps to delete the personal information we collect when (1) we have a legal obligation to do so, and (2) we no longer have a purpose for retaining the information. We may also decide to delete information if we believe it is incomplete, inaccurate, or that our continued storage of it is contrary to our legal obligations or business objectives. When we delete data, it will be removed from our active servers and databases; but, it may remain in our archives when it is not practical or possible to delete it.

To the extent permitted by law, we may retain and use de-identified, anonymous or aggregated information for performance reporting, benchmarking, and analytic purposes and for product and service improvement.

HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

We have put security measures in place to protect the personal information that you share with us from being accidentally lost, used, altered, disclosed, or accessed in an unauthorized manner. From time to time, we review our security procedures to consider appropriate new technology and methods.

While our security measures seek to protect your personal information in our possession, no security system is perfect, and no data transmission is 100% secure. As a result, while we strive to protect personal information, we cannot guarantee or warrant the security of any information transmitted to or from the App. Your use of the App is at your own risk. We cannot guarantee that personal information will remain absolutely secure in all circumstances.

If a data breach compromises your personal information, we will notify you and any applicable regulator when we are required to do so by applicable law.

YOUR RIGHTS AND CHOICES

Please use the “Contact Us” details provided at the end of this Notice to exercise your rights and choices. We honor such requests when we are required to do so under applicable law.

Children’s Online Privacy. Please see the “Children’s Online Privacy” section of this Notice for more information regarding parents’ rights and choices.

Email Opt-Out. If you no longer wish to receive communications from us via email, you may opt-out by clicking the “unsubscribe” link available at the bottom of our email communications or by contacting us at support@getpraxis.app and providing your name and email address so that we may identify you in the opt-out process.

Accuracy and Updating Your Personal Information. Our goal is to keep your personal information accurate, current, and complete. If any of the personal information you have provided to us changes, please let us know via the “Contact Us” details at the end of this Notice. For example, if your email address changes, you may wish to let us know so that we can communicate with you. If you become aware of inaccurate personal information about you, you may want to update your information. We are not responsible for any losses arising from any inaccurate, inauthentic, deficient or incomplete personal data that you provide to us.

Complaints. If you believe your rights relating to your personal information have been violated, please contact us via the “Contact Us” details provided at the end of this Notice.

CHILDREN’S ONLINE PRIVACY

The Children’s Online Privacy Protection Act (“COPPA”) regulates the online collection, use, and disclosure of personal information from children under the age of 13. However, COPPA only applies to information collected online from children. It does not apply to information collected from adults, like our accountholders, that may pertain to children. Personal Information Collected from Children under 13. We do not knowingly collect personal information from children under the age of 13. Rather, for players under the age of 13, only a parent or legal guardian is allowed to register an account, and only the parent or legal guardian may submit Player Profile Information for children under the age of 13. As explained above, during registration parents of children under 13 provide the player’s name. If the player’s team is using the App, the player’s club, age-group, and team will be pre-populated based on the registration code and information from the team. Once you have registered and subscribed to our services, you will create a profile for the player. You may choose to provide the player’s photo as well as videos and content that you submit to be reviewed by the coach. We will track which challenges the player has completed. This information is only used and shared as described in the “How Do We Use and Share Your Information” section of this Notice.

If you are under 13, please do not use or provide any information on the App. If we learn that we have collected personal information from a child under the age of 13 without a parent’s or legal guardian’s consent, we will take steps to stop collecting that information and delete it. If you believe we might have any information from or about a child under the age of 13, please contact us using the contact information provided below.

Third-Party Operators. We do not have any third-party operators (such as an advertising network or social network plug-in) that collect or maintain children’s personal information through the App.

Parental Rights. Although we do not collect information from children under 13, we are committed to privacy and transparency. We do not require disclosure of more information than is reasonably necessary to participate in the App. In addition, parents may review personal information about their child on the App, direct us to delete it, and refuse to allow further collection or use of the information by deleting their account. Parents may also restrict certain disclosures of personal information (however, parents cannot for example, restrict disclosures to coaches which are required as part of our services). To exercise these rights, please contact us using the “Contact Us” details provided at the end of this Notice.

THIRD-PARTY SITES

This Notice only applies to the App, and it does not apply to any third-party websites.

The App may contain links to, and media or other content from, third parties. These links are to external resources and third parties that have their own privacy policies. Because of the dynamic media capabilities of the App, it may not be clear to you which links are to external, third-party resources. If you click on an embedded third-party link, you will be redirected away from the App to the external third-party website. You can check the URL to confirm that you have left the App.

Some third parties may use automated data collection technologies to collect information about you when you browse the Internet.  The information they collect about your online browsing activities over time and across different websites and other online services may be associated with your personal information and used to provide you with targeted content.  We do not control these third parties’ technologies or how they may be used.  If you have any questions about targeted content, you should contact the responsible party directly or consult their privacy policies.

We cannot and do not (1) guarantee the adequacy of the privacy or security practices employed by or the content and media provided by any third parties or their websites, (2) control third parties’ independent collection or use or your information, or (3) endorse any third-party information, products, services or websites that may be reached through embedded links on the App.

Any information provided by you or automatically collected from you by a third party will be governed by that party’s privacy policy and terms of use. If you are unsure whether a website is controlled, affiliated, or managed by us, you should review the privacy policy and practices applicable to each linked website.

UPDATES AND CHANGES TO THIS NOTICE

We may add to, change, update, or modify this Notice to reflect any changes to how we treat information or in response to changes in law. Should this Notice change, we will post all changes to this Notice on this page. If we make material changes, we will also notify you through a notice in the App or via email. Any such changes, updates, or modifications will be effective immediately upon posting. The date on which this Notice was last modified is identified at the beginning of this Notice.

You are expected to carefully review this Notice before using the App, and you acknowledge and agree that this is your responsibility. You should also review this Notice from time to time after that so that you are aware of any changes. Your continued use of the App after the “Last Updated” date will constitute your acceptance of and agreement to the changes made and to our collection and sharing of your information according to the terms of the then-current Notice. If you do not agree with this Notice and our practices, you should not use the App.
